The EU GPSR (General Product Safety Regulation) is the safety regulation for all products not covered by a sectorial legislation. With a broad application scope, all manufacturers selling in the EU should verify whether the GPSR, either partially or fully, apply to their business and products. Overall, the GPSR covers consumer products, whether new, used, repaired or reconditioned. These include items as well as apps and software products.
The European Commission issued guidelines on the application of the EU general product safety legislative framework for the different economic operators.
Checklist for manufacturers of general products
The EU General Product Safety Regulation defines the manufacturer as “any natural or legal person who manufactures a product or has a product designed or manufactured, and who markets the product under the person’s name or trademark”. This means that a company qualifies as manufacturer if they sell the product under their own name or trademark, even if they do not manufacture the product. The manufacturer’s main obligation is ensuring that the products placed on the market are safe.

Appoint a GPSR Responsible Person
All manufacturers must have a Responsible Person on the Union market. Whether through traditional sales channels or e-commerce, products cannot be shipped in the EU without a Responsible Person.
