GPSR focus: what is Safety Gate and who needs to register?

The EU General Product Safety Regulation introduces the obligations to use an alert system for dangerous products. The Safety Gate system serves as a coordinated alert mechanism to share information about dangerous non-food products and corrective measures taken against them among national authorities within the Union market.

How does Safety Gate Portal work?

The Safety Gate system is used by different actors and authorities, including the European Commission:

  • Manufacturers are obliged to immediately notify dangerous products and without undue delay notify accident caused by a product. Businesses use a dedicated portal called Safety Business Gateway for submitting these notifications. Once submitted, the notifications are directed to the relevant Member State authorities.
  • The Safety Gate portal also enables consumers to report dangerous products purchased on the EU single market (including EU Member States, Iceland, Norway, and Liechtenstein), whether bought online or offline. The interface dedicated to consumers is called Consumer Safety Gateway.
  • Providers of online marketplaces are obliged to register on Safety Gate.
  • Member States notify corrective measures taken through the Safety Gate Rapid Alert System.

The alerts for dangerous products reported are publicly available via the Safety Gate website.

Obligations to register for online marketplaces

The new EU GPSR includes explicit provisions for distance sales. Among others, providers of online marketplaces have an obligation to register with the Safety Gate Portal, as specified in Article 22.1. To fulfil this obligation, the Portal has a module dedicated specifically to online marketplace registration.

Firstly, providers of online marketplaces have to create a EU login account. The European Commission also provides a EU login tutorial to guide businesses.

In the registration, online marketplaces need to include:

  • Contact information of their single point of contact
  • Business name, email address, phone number, business logo and website

Afterwards, it will be possible to access the module to manage business details and contact points per product category, as well as access data via interoperability process.

Responsible Person for general products

All general products must have a EU based Responsible Person, independently from business size and country of origin.
