European Parliament supports temporary suspension of EPR authorised representative for EU SMEs

In today’s session on 20 October, the European Parliament voted in favour of the suspension the application of the rules on extended producer responsibility for batteries and waste batteries and packaging and packaging waste. The vote on procedure 2025/0395 (COD) passed with 616 in favour, 9 against, and 39 abstentions.

The Proposal has received positive vote from the Parliament’s responsible committee (ENVI) earlier this October with some amendments compared to the text proposed by the Commission.

Temporary suspension for EU SMEs

The temporary suspension would be restricted to microenterprises and small enterprises established in the EU. Medium-sized and large enterprises would still be subject to mandatory rules of appointing an authorised representative for extended producer responsibility (EPR). The suspension would end on January 2035 or on the application date of the expected act, whichever is earlier. These amendments would not exempt producers from other EPR obligations, such as financial contributions or recycling targets.

The amendments concern the EU PPWR and EU Battery Regulation.

The Parliament is also calling for better information exchange between EU Member States, interoperable digital systems, and common reporting requirements.
