New Toy Safety Regulation officially published

After the Council’s approval and Parliament’s adoption in November, the Official Journal of the EU released the new Toy Safety Regulation on 12 December 2025. Regulation 2025/2509 replaces the current Directive with the aim to decrease the number of unsafe toys on the Union market.

New rules for toys from 2030

The Regulation enters into force on 23 December 2025. The new rules apply from 1 August 2030, with the exception of the following articles that apply from 1 January 2026:

  • Article 28 on the notification from Member States to the Commission and the other Member States about conformity assessment bodies designated under the new Toy Regulation.
  • Article 44 on coordination of notified bodies.
  • Article 49 on delegated powers.
  • Article 55 on penalties that Member States have to lay down for infringements to the Toy Regulation.

Transitional provisions: Directive to Regulation

Toys compliant with the current Directive (Directive 2009/48/EC) can continue being placed on the market before 1 August 2030. Conformity assessment certificates remain valid until 1 February 2031, unless they expire before that date. Chapter VIII on market surveillance applies instead of Article 42, 43 and 45 of the current Directive to toys placed on the market in conformity with the Directive before 1 August 2030.

The new Regulation introduces significant changes, and manufacturers are expected to begin preparing in order to maintain compliance.
